Learn Your IEP Parents Rights

An IEP or Individualized Education Plan meeting is required for any child that has trouble in school learning or not at grade level. It is important that folks know their IEP parents rights and that this is law that is in place to protect the child. This Civil Right requires schools provide for the needs of any student who is learning disabled so that they can receive an education.

The IDEA or Individuals with Disabilities Education Improvement Act, is a law designed for children who are learning disabled. Some school districts are not very forthcoming when it comes to providing resources they are mandated by law to provide. For this reason it is vital that parents know how to advocate for their children.

At the parents request the district is obligated to offer an assessment for free of the child in all areas they are suspected to have learning disabilities. Some of these areas are social and emotional behaviors, health, vision, hearing, fine and gross motor skills, attention deficit problems, meeting potential, and grade level success. Once assessment is complete the school is to call an IEP eligibility meeting to see if the student meets special education services criteria.

If the child is determined to be eligible for services they are protected by state and federal law. This means that the school is mandated under the law to provide services to the child. If a child is not determined to be eligible for special education the school district is not required to provide anything.

If a child is found to be eligible, the school district I required to provide a plan that provides resources, goals, and services. When a plan has been laid out the district must implement an IEP for the particular student. What this means is the student will remain in the general education classroom and he or she receives pushed in or pulled out special education services. The child is ensured of receiving benefits of an education with these services.

It is sad to say that some school districts often keep students from being identified as special education services eligible. This happens because there are districts that prefer not to put money out for students with learning troubles. It is a general opinion that many school limit the budget for special ed services on purpose. It is interesting to note that in all IEP team meetings one member is responsible for budgetary concerns.

A child with learning disabilities is in a protected class and is to be treated equally receiving educational benefits. This consists of getting important supplementary resources so they are able to learn to the extent that the other children do in their class. The IDEA is not like other civil rights laws in that it requires parents to enforce the rights of their children.

To ensure a childs rights are protected, parents need to understand the law. There are many times when a parent is told their student is not eligible for special education services. Even though a district is required by the law to offer services, it is board politics that often overrides this law. It is on parents to fight to get their child services.
