South American Marijuana Laws

In South America marijuana laws differ from country to country. Practices and culture vary over such a large area. Here is a snapshot.

Argentina: Possession of small amounts for personal use is legal. Consumption and use in private locations is also legal. Public consumption is tolerated. The use of medical marijuana is widely tolerated, but not legal aside from provisions for use in private locales. Commercial volume production, sale and transporting is against the law.

Bolivia: Marijuana possession is illegal. Possession of more than a personal amount is subject to incarcerations and forced treatment. Meanwhile, coca leaf use is tolerated.

Brazil: Possession of marijuana has been De-penalized. This means that possession for personal consumption can result in a warning, drug education and community service. The same rules apply to cultivation of small amounts of marijuana.

Chile: Medical marijuana is legal and not regulated. Consumption and possession on private property is, like Argentina, legal. Consumption by groups is illegal. Cultivation is only legal with a permit.

Colombia: Possession of up to 1 gram is decriminalized. Sale of marijuana is illegal. Cultivation is also illegal. Enforcement is reportedly relaxed, however.

Ecuador: Possession of marijuana is not illegal. Cultivation is illegal. Sale is also illegal.

Paraguay: Marijuana is illegal in Paraguay. However, Paraguay is reportedly one of the largest marijuana producers in South America. Possession of small amounts is not treated harshly.

Venezuela: Possession of even small amounts is punishable by law, at the discretion of the judge. Drug treatment is mandatory for offenders. Possession of small amounts is treated lightly. Sale and distribution is frowned upon.

As has been shown, marijuana laws vary widely throughout South America. While the drug trade is always illegal, personal use is sometimes permitted. Police enforcement varies, with it being a very low priority in some countries. Medical cannabis use is permitted in some countries.
